It’s the bread and butter of the real estate sector. While oftentimes neglected in legal counselling, we consciously put it at the centre of our services. As standardization has advanced to a high degree, we are in particular able to offer very good quality legal advice at very competitive conditions in this field. We assist landlords, tenants, and asset managers with respect to all legal issues, especially with respect to the following matters:
  • Drafting and negotiation of tenancy agreements and amendments to tenancy agreements
  • Drafting and negotiation of asset management and facility management agreements
  • Assistance with the legal aspects of alterations and expansions as well as restructuring measures of existing buildings

Das Asset-Management von Immobilien, und dabei insbesondere die Mietverträge, sind von großer Bedeutung für den Wert einer Immobilie. Ein weiterer Schwerpunkt unserer Tätigkeit ist daher das Legal-Asset-Management.

Thanks to our many years of experience in this field, we are especially familiar with the special features of the various markets and their players. Our clients in this field include real estate funds, capital investment companies, as well as owners of office and retail properties, shopping centres, specialist retailers, storage areas and logistics areas, as well as residential properties.

In this context, we provide advice to our clients irrespective of whether it is about project developments or existing properties. The scope of our advice includes the preparation or adjustment of bespoke tenancy agreement templates, the conceptualization, review, and negotiation of tenancy agreements, amendments, and any other contracts relating to real estate (e.g., asset management agreements, property management agreements, and facility management agreements) as well as long-term usage rights (e.g., according to the WEG [Wohnungseigentumsgesetz, German Act on the Ownership of Apartments and the Permanent Residential Right] or in the context of tenants’ easements). Additionally, we assist our clients in reviewing the billings for operating costs and ancillary costs.

Needless to say, we will enforce our clients’ rights in court where required, although we are always first and foremost concerned with finding an amicable solution.

Real estate asset management is yet another field in which our multidisciplinary co-operation comes into effect, so that, as a matter of course, any questions relating to public and private construction law will be answered comprehensively.
